The Queensland Law Society has issued a Conveyancing Protocol which establishes strict systems for the handling of a conveyance. The Conveyancing Protocol was established because most negligence claims against lawyers arose in the area of conveyancing and as a result of defective conveyancing systems. Our conveyancing practice adheres to the QLS protocols and at Rouse Lawyers we treat conveyancing like any other commercial transaction.

What is conveyancing?

Conveyancing is the legal process of transferring ownership of property. It includes necessary checks and searches that ensure that the seller legally owns the land, and that the buyer takes the land without any unexpected encumbrances.

What happens if there is a problem with my contract?

Do I need to attend your office during my sale/purchase?

Not necessarily. You are welcome to come in and see us if you want to, but most conveyances can be completed by phone, fax, email and post.

What is transfer/stamp duty and do I need to pay it?

Transfer duty or stamp duty is a tax imposed by the Queensland Government on the purchase of property in Queensland. Under the standard contract of sale, transfer duty is payable by the buyer. It is determined by the purchase price of the property together with any concession you may be entitled to.
